Update on the Queen of the North Class Action


Our requests to have the matter mediated or alternatively assessed by a Judge during a judicial settlement conference have been rejected by the Defendant. We have therefore pursued a litigation process whereby mini trials are held to assess the claims of individual passengers. Hearings were held during the weeks of April 27 and June 15, 2009, during which the cases of six passengers were presented to the Court in the form of mini trials. Judgment has been reserved on these six cases but we do expect that judgment will be handed down during the month of August.

We expect that the next batch of cases will be selected soon, in order to be prepared for further mini trials to be held this year. We will shortly be in contact with those passengers whose claims are selected to be part of the next trial batch. With respect to the Dependant Claims, we anticipate that those dependants who indicated to us, on or prior to the notice deadline, that they wish to institute a claim, will have their claims heard together with the individual passenger's claim of whom they are a dependant. Should there be a change in the litigation process currently being implemented, we will report such change to all the members of the Class forthwith.
