Canada Pension Plan (CPP) Victory for Client
Mr. Obregon is a middle-aged man with a grade 12 education who worked as a truck driver. As a result of a work related accident, he sustained a persoanl injury - disabling back pain and headaches. He attempted to return to work several times before accepting he was totally disabled from his job.
He applied for a disability benefits pension under the Canada Pension Plan (CPP) in April 2008. The application for disability benefits was denied on the basis that he was not disabled.
Mr. Wirsig, a partner at Hanson Wirsig Matheos, successfully argued that the medical and other evidence supports the conclusion that Mr. Obregon’s disability is sufficiently severe that it prevents him from regularly pursuing any substantially gainful occupation, given his age, education level, language proficiency and past work and life experience.
Mr. Obregon is now receiving his disability benefits.
