Client Wins ICBC Court Case
Ms. Hauer sustained an ICBC personal injury claim in a motor vehicle accident on August 6, 2006. Following this car accident, Ms. Hauer hired Jim Hanson, a partner of Hanson Wirsig Matheos. Her primary concerns were over persistent low back and shoulder pain. The matter went to trial as ICBC took the position that her ongoing shoulder and back pain were not primarily caused by the car accident. ICBC also took the position that her injuries had little or no impact on her work capacity. Ms. Hauer won her court case.
The court accepted the evidence that Ms. Hauer was active and fully able to perform the physical demands of her employment before the accident, and after the accident, is no longer as active or able to perform to the pre-accident level. The court accepted the evidence of Ms. Hauer, the lay witnesses, and Dr. Richardson, that there is a causal connection between the accident and her ongoing shoulder pain, and establish, as fact, the contribution of injuries sustained in the accident to the present condition of her shoulder.
The court found that Ms. Hauer’s enjoyment of life has been significant diminished by her persistent pain from her shoulder injury.
